Terms of Service

These Terms of Service ("Terms") are an agreement between you and Jason Xie & Drew Simpson ("we," "us," "our") governing your use of the ScrapIt mobile app and website. They are written in plain language but are a real, binding agreement. By creating an account or using ScrapIt, you agree to these Terms. If you do not agree, do not use the app. For questions, email [email protected].
1. Acceptance of terms
By creating a ScrapIt account, downloading the app, or using any part of the service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
If you are using ScrapIt on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and "you" refers to that organization.
2. Eligibility
You must be at least 13 years old to use ScrapIt. If you are between 13 and the age of majority in your jurisdiction (typically 18 or 19), you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf, or that you have legal capacity to enter agreements under the laws of your jurisdiction.
ScrapIt is not directed to children under 13. If we learn that a user is under 13, we will delete that account and all associated data.
3. License grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download, install, and use the ScrapIt app on devices that you own or control, solely for your personal, non-commercial use
- Access and use the ScrapIt website for personal, non-commercial purposes
This license does not include any right to: sublicense or transfer the app to another person; modify, reverse-engineer, decompile, or disassemble the app; use the app for any commercial purpose or for any public display; or remove or alter any copyright, trademark, or other proprietary notice in the app.
iOS devices: For users on Apple-branded devices, this license is further limited to use on Apple-branded products in accordance with the Usage Rules set out in the Apple Media Services Terms and Conditions. See also Section 17 (Apple App Store Additional Terms) below.
We reserve all rights in the app and service not expressly granted to you in these Terms. We may update, modify, suspend, or discontinue any part of the service at any time.
4. Account responsibilities
You are responsible for all activity that occurs under your ScrapIt account. Specifically, you agree to:
- Provide accurate, current, and complete information when creating your account
- Keep your login credentials secure and not share them with others
- Notify us immediately at [email protected] if you believe your account has been compromised
- Maintain and promptly update your account information to keep it accurate
- Accept responsibility for all activities that occur through your account
We reserve the right to suspend or terminate accounts that appear to be impersonating another person, that provide false information, or that are otherwise set up fraudulently.
5. Your content (user-generated content)
You retain ownership
You own the photos, captions, album titles, descriptions, and other content you create and upload in ScrapIt ("Your Content"). These Terms do not transfer ownership of Your Content to us.
License you grant us
By uploading content to ScrapIt, you grant us a limited, worldwide, royalty-free, non-exclusive license to host, store, process, reproduce, and display Your Content solely as necessary to operate the ScrapIt service — including to show it to you and to the specific people you choose to share it with. This license exists only to make the app work as intended and for no other purpose. We do not use Your Content for advertising, training AI models, or any other independent purpose.
When you delete your account or remove a memory, we delete the associated content from our systems as described in our Delete Account page. The license you granted us for that content terminates upon deletion, except for legally required retention described in the Privacy Policy.
Your representations about content
By uploading any content to ScrapIt, you represent and warrant that:
- You own the content or have obtained all rights, licenses, and permissions necessary to upload it and to grant us the license above
- Where Your Content includes photos of other people, you have obtained any consent required by applicable law before uploading or sharing those photos
- Your Content does not infringe the copyright, trademark, privacy, publicity, or other intellectual property or personal rights of any third party
- Your Content complies with these Terms, including the prohibited conduct listed in Section 6
6. Acceptable use and prohibited conduct
ScrapIt is a private space for personal memories. To keep it safe for everyone, the following conduct is prohibited. Violations may result in immediate content removal, account suspension, or permanent account termination. We have a zero-tolerance policy for the categories marked below.
Zero tolerance — these result in immediate account ejection
- Content that exploits or endangers minors, including any sexual content depicting minors. We report all such content to the appropriate authorities and law enforcement as required by law.
- Non-consensual imagery — sharing or uploading private images or videos of any person without their explicit consent.
- Illegal content of any kind, including content that promotes or facilitates illegal activity.
- Credible threats of violence directed at any person or group.
Also prohibited
- Uploading or sharing someone else's private photos or content without their permission
- Harassing, threatening, bullying, or intimidating another person through the app
- Uploading content that infringes a third party's copyright, trademark, or other intellectual property rights
- Impersonating another person, brand, or entity, or misrepresenting your identity or affiliation
- Attempting to bypass, circumvent, or disable ScrapIt's safety, reporting, access-control, or authentication systems
- Scraping, crawling, or using automated tools to extract data from the service
- Using the app for any commercial purpose without our prior written consent, including spam, unsolicited promotions, or phishing
- Knowingly uploading content containing malware, viruses, or other harmful code
These rules are further elaborated in our Community Guidelines.
7. Content moderation, reporting, and blocking
ScrapIt hosts user-generated content, and we maintain the following safeguards so the service stays safe: content standards that filter objectionable material (defined in Section 6 and our Community Guidelines and accepted by every user at signup), an in-app mechanism to report offensive content and users, the ability to block abusive users, and published contact information so you can always reach us. These reflect the requirements of Apple App Store Guideline 1.2 and Google Play's user-generated content policy.
Reporting content or users
If you encounter content or behavior that you believe violates these Terms or our Community Guidelines, use the in-app report function on the memory, photo, or user profile in question. You can also contact us directly at [email protected].
We take every report seriously. For reports of objectionable content, we commit to acting within 24 hours — this means reviewing the report, removing violating content, and ejecting any user who provided objectionable material.
Blocking a user
You can block any other ScrapIt user at any time from their profile or from a memory they have shared with you. Blocking prevents that user from sharing further content with you. You can also remove any shared memory from your view at any time without blocking.
Our enforcement discretion
We reserve the right to remove any content and to suspend or terminate any account that we determine, in our sole discretion, violates these Terms, our Community Guidelines, or applicable law. We are not obligated to provide advance notice before removing content or taking action on an account, particularly for zero-tolerance violations.
We may also cooperate with law enforcement or other authorities and disclose information about your account where required by applicable law, a valid legal order, or to protect the safety of users.
8. Sharing features and consent
ScrapIt allows you to share memories and albums with other users you choose. When you share a memory with someone:
- The recipient receives a copy of that memory in their own private ScrapIt account
- That copy belongs to the recipient and may persist in their account even if you later delete your original or your entire account
- You are responsible for only sharing content that you have the right to share and for only sharing with people who you have reason to believe consent to receiving it
Think carefully before sharing. Once a memory is shared, the recipient has their own copy and you cannot retrieve it from their account, though they can remove it from their view at any time and you can block them from receiving future shares.
9. Intellectual property
All intellectual property rights in the ScrapIt app, website, and underlying technology — including but not limited to software, design, trademarks, logos, and branding — are owned by Jason Xie & Drew Simpson or our licensors. Nothing in these Terms grants you any right in our intellectual property beyond the limited license in Section 3.
"ScrapIt" and the ScrapIt logo are trademarks of Jason Xie & Drew Simpson. You may not use our trademarks without our prior written consent.
9A. Copyright complaints and DMCA notice-and-takedown
We respect intellectual property rights and expect our users to do the same. Although Jason Xie & Drew Simpson is based in Canada, we provide the following notice-and-takedown process consistent with the U.S. Digital Millennium Copyright Act (DMCA) for the benefit of rights holders and to support our service's users worldwide.
Reporting copyright infringement (takedown notice)
If you believe content on ScrapIt infringes a copyright you own or control, send a written notice to our designated copyright agent at [email protected] (subject line: "Copyright / DMCA Notice"). To be effective, your notice must include:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and information reasonably sufficient to let us locate it within the app
- Your contact information (name, address, telephone number, and email address)
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
Our response
Upon receipt of a valid notice, we will expeditiously remove or disable access to the allegedly infringing material and make a reasonable effort to notify the user who posted it.
Counter-notice
If you believe your content was removed in error or misidentification, you may submit a counter-notice to the same address. A valid counter-notice must include your signature, identification of the removed material and its prior location, a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, your contact information, and your consent to the jurisdiction of an appropriate court. If we receive a valid counter-notice, we may restore the content in 10–14 business days unless the original complainant notifies us that they have filed a legal action seeking to restrain the allegedly infringing activity.
Repeat-infringer policy
In accordance with the DMCA and our own standards, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of intellectual property rights. We may also remove content and terminate accounts for copyright infringement at our discretion, with or without notice.
10. Termination and account ejection
Termination by you
You may stop using ScrapIt and delete your account at any time via Settings or Profile → Delete Account in the app, or by submitting a request via our Delete Account page. Deletion is permanent.
Termination by us
We may suspend or permanently terminate your account, with or without notice, if we determine that you have violated these Terms, our Community Guidelines, or applicable law. For zero-tolerance violations (Section 6), termination is immediate and without warning. For other violations, we may provide notice and an opportunity to cure where appropriate, at our discretion.
Upon termination for cause, we will not be obligated to refund any amounts paid (once paid features are available). Upon your voluntary deletion, data is removed as described in the Delete Account page.
Effect of termination
Upon any termination, your license to use ScrapIt ends immediately. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
11. Disclaimers
ScrapIt is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We work hard to keep the service reliable and your memories safe, but we cannot guarantee that:
- The app will always be available, error-free, or uninterrupted
- The app will be free from bugs, defects, or security vulnerabilities
- Content stored in the app will never be lost due to technical failure
- Every reported violation will be detected before any harm occurs
Please keep independent backups of any photos or content that are irreplaceable to you. ScrapIt is a convenience, not a backup service.
Nothing in these Terms is intended to limit any rights you have that cannot be excluded or limited under applicable consumer protection law.
12. Limitation of liability
To the fullest extent permitted by applicable law, in no event will Jason Xie & Drew Simpson, its directors, employees, contractors, agents, or licensors be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of or inability to use ScrapIt — including loss of data, loss of profits, loss of goodwill, or cost of substitute services — even if we have been advised of the possibility of such damages.
To the extent our total liability to you is not excluded entirely under applicable law, our aggregate liability to you for all claims arising under or related to these Terms or your use of ScrapIt will not exceed the greater of (a) CAD $100 or (b) the total amounts you paid us in the 12 months preceding the claim (currently zero, as ScrapItis free).
Some jurisdictions do not allow limitations of liability for personal injury or for certain consumer claims. Nothing in these Terms limits liability that cannot be limited under applicable law, including Ontario consumer protection law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Jason Xie & Drew Simpson and its directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of or access to ScrapIt; (b) your violation of these Terms; (c) your violation of any third party's rights, including any intellectual property, privacy, or publicity right; or (d) any content you upload, share, or transmit through the service.
14. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of ScrapIt will be resolved in the courts of Ontario, Canada, and you consent to personal jurisdiction in those courts. If you are a consumer in a jurisdiction that requires disputes to be resolved locally (such as certain EU member states), you retain any statutory rights to bring proceedings in your local courts that cannot be waived by contract.

15. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in-app or by email. Continued use of ScrapIt after updated Terms take effect constitutes your acceptance of the new Terms. If you do not agree with a change, you can delete your account at any time.
16. Subscriptions and in-app purchases (future)
ScrapIt does not currently offer paid subscriptions or in-app purchases. If we introduce them in the future, the following will apply and this section will be updated:
- Subscriptions will be billed through Apple App Store or Google Play using your platform payment method, subject to the respective platform's payment terms
- Prices, billing periods, and features will be disclosed clearly before purchase
- Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage and cancel subscriptions in your Apple ID settings (apps.apple.com/account/subscriptions) or Google Play account settings
- Account deletion and subscriptions: Deleting your ScrapIt account does not automatically cancel an active subscription. You must cancel through your App Store or Google Play account separately to stop future charges
- Refund requests are handled through the App Store or Google Play per their respective refund policies
17. Apple App Store additional terms
If you downloaded ScrapIt from the Apple App Store, the following additional terms apply. These terms are required by Apple and are between you and Jason Xie & Drew Simpson (not Apple):
- Parties: This agreement is between you and Jason Xie & Drew Simpson only, and not with Apple, Inc. ("Apple"). Jason Xie & Drew Simpson, not Apple, is solely responsible for the ScrapIt app and its content.
- Scope of license: The license granted to you for ScrapIt is limited to a non-transferable license to use the app on any Apple-branded products that you own or control, in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions.
- Maintenance and support: Jason Xie & Drew Simpson, not Apple, is responsible for providing maintenance and support services for ScrapIt. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to ScrapIt.
- Warranty: In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to ScrapIt, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Jason Xie & Drew Simpson's sole responsibility.
- Product liability and legal compliance: Jason Xie & Drew Simpson, not Apple, is responsible for addressing any claims by you or any third party relating to ScrapIt or your possession and/or use of ScrapIt, including: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property infringement: In the event of any third-party claim that ScrapIt or your possession and use of the app infringes that third party's intellectual property rights, Jason Xie & Drew Simpson, not Apple, will be responsible for the investigation, defense, settlement, and discharge of any such claim.
- Legal compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with all applicable laws when using ScrapIt.
- Third-party agreements: You must comply with applicable third-party terms of agreement when using ScrapIt — for example, if ScrapIt uses your wireless data plan, you must comply with your wireless data service agreement.
- Apple as third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

18. Google Play additional terms
If you downloaded ScrapIt from Google Play, your use of the app is also subject to the Google Play Terms of Service and Google's applicable policies. To the extent of any conflict between the Google Play Terms and these Terms, these Terms will govern (except where Google's terms expressly take precedence with respect to the Google Play platform itself).
